Problems with property in Punjab, India

Dear NRI Online Readers,

I am Amrican Citizen. I had some property in India, property was my fathers name. My father is very sick. My brother is useing my fathers thumb mark and selling my share of property. I mailed the complaint to SSP Patiala, DC Patiala, CM Punjab. Nobody is taking any action. I read every day in news,on internet, papers about NRI Rights. What kind of rights we have?Nobody wants to take any action. I mailed 2-3 e-mails to NRI departmant in Patiala no answer.

This is the complaint I filed to SSP Patiala, DC Patiala, CM of Punjab in India.

To,

The Honrable Chief Minister Sahib,
Punjab, India.

Sub:Complaint against Smt. Manmeet Kaur w/o Kulwinder Singh s/o Gurbax Singh r/o Dhillon House, Sanour Tehsil Patiala regarding my land situated at Sanour, Tehsil Patiala for taking the undue advantage of my status of Non-resident Indian, fraudulently and wrongfully transferred by way of gift Deed bearing Number 9010 d 14-11-2000 on behalf of Gurbax Singh (Retired Captain from Indian Army, father of Kulwinder Singh and Satinder Singh). Kulwinder Singh also threatening to transfer my share of joint property includes agricultural land, shops, and house situated in Sanour Tehsil Patiala, bank balance and building on lease with State Bank of Patiala on his name.

Sir,
It is submitted as under: -

1. That I am co-owner in ancestral property comprised of agricultural land situated at village, Sanour Tehsil Patiala and joint owner of properties, that includes house, shops, and a building on lease with State bank of Patiala at Sanour.

2. That after the death of our respected mother Smt. Jagbir Kaur in 1997, the above agricultural land was partitioned, in that land measuring 55 Kanal 3 Marlas was given to me (Complainant), and 55 Kanals and 8 Marlas were given to Kulwinder Singh wide Rapat # 550 of Halka Patwari on 07/08/1997. And out of above property one shop was given to Kulwinder Singh and One shop to me. One Half of the building leased to bank was owned by Smt. Jagbir Kaur. After death of Smt. Jagbir Kaur her share was given to Kulwinder Singh and me. Thus I own ¼ of the building and ¼ is owned by Mr. Kulwinder Singh.

3. That Smt. Jagbir Kaur, had already given the portion of the house in her life time to my elder brother Gurinder Singh Dhillon, lambardar Sanour about 10/15 years ago. After the death of Smt. Jagbir Kaur, Kulwinder Singh occupied the whole house including the ½ share of their father, and 1/4 my share.

4. About two moths ago, taking the undue advantage of week health and inability to make right decision due to stroke, and illness of their father, Kulwinder Singh fraudulently and wrongfully, fabricated a gift deed of my share in ancestral land in favor of his wife Smt. Manmeet Kaur. He secured my father’s thumb impression for forging a gift deed without making him aware of what he was doing. My father served in the army as a Captain, he could easily and effectively put his signature had he knew what he was doing. He is also trying to deceive me be transferring my remaining share in movable and immovable properties in India.

5. The mother and father executed a will in their life time distributing all the properties among their children. Kulwinder Singh had got possession of all those documents. Gurbax Singh our father had stroke in 1998 and 1999. He was treated in United States during his stay with me at his residence. He had heart surgery and prostrate cancer surgery in United States of America during his stay at my residence. All this took a toll on his health and ability to make sound decisions.

6. Kulwinder Singh taking the undue advantage of his father’s health is wrongfully, fraudulently, forged documents to deprive me of my share in the ancestral property. I am unable to pursue my interests personally being Non Resident Indian, and thus I have appointed Mr. Gurinder Singh my power of attorney.

7. Kulwinder Singh is known for all illegal activities and forging documents in his favor.
a. He has tampered his real date of birth to gain advantage in his favor. He recorded his date of birth as 28/03/1958 with Punjab Electricity Board whereas his actual date of birth is 28/03/1955, and he was born at Malerkotla District Sangrur. This fact can be verified from father’s army records.
b. In 1977 he was disqualified from taking pre university examination of Punjabi University for cheating during the examination.
c. He let some one else take examination for himself for promotion with Punjab State Electricity Board. These facts should be investigated and he should be punished according to the law of the land.
d. He persuaded some one else to take B.A. examination for him, and thus acquired a forged degree of B.A. This fact can be verified by checking his hand writing.
e. Now he helped his wife to gain a forged gift deed of my share in land and other properties in India.
f. He deprived the other bother and sisters to visit ailing father to cover his illegal acts.

So through this complaint, I humbly request that the above matter may please be enquired and appropriate action be taken to protect my interests in ancestral property. It is very hard for me to protect my interest while residing in United States of America. I do have full confidence in Indian justice and administrative system that it will provide Non Resident Indian protection.
