It seems you are unnecessarily worried. As soon as the new (or would be) employer files a H-1 transfer for you, your status becomes valid and you can legally wait (but not work) for your transfer to come through. You can however continue (if you wish) with the current employer who holds your H-1B.
Your old (or even new) employer can in no circumstance threaten you. Instead if you complain about your employer to INS, the company will be in hot water.
Check the official INS site for more exciting new ruling about H-1 B. You can also check immigration.com.
