Subject: H1B Visa - Can employers threaten you?
Hello,
I have a serious issue with these H1B employers who think they can threaten you if you get a better offer with another company. Is this legal? A friend of mine has an H1B visa through company A. My friend gets a great offer from company B. He decides to go with the better offer and give employer A two weeks notice. Employer A threatened him saying that he would write a letter to INS stating that he is no longer an employee.
They are making him write a letter of resignation, but he has not even resigned yet. Company B is going to do his transfer but my question is: how long does he have before he becomes illegal in the US? CAN HE SUE THIS COMPANY because under their contract they were supposed to give him 2 weeks notice? They have not done so. What procedures must he take?
I really need help on this subject. Please help me ASAP! I am sure there are others who have come across the same situation.
